Terms of Service

The short version. Accounts are for the organization that holds them. Prices are the published ones. Subscriptions cancel anytime and run to the end of the paid period. The data is public-record analytics, served with provenance, as-is except where an Enterprise agreement or the API Terms say otherwise. Don't use the products to profile private individuals or for FCRA-regulated decisions.

The deal

These Terms govern your use of atcstw.com, api.atcstw.com, and suite.atcstw.com (the "Services"), operated by ATCSTW. By using the Services you agree to these Terms. If you use the Services for an organization, you represent that you may bind it.

The services

ATCSTW provides the Data API, versioned data packs, the Nonprofit Suite, and related tools and documentation. Features, datasets, and endpoints may be added, changed, or removed; material removals affecting paid tiers are announced to account emails in advance. Dataset coverage and cadence are as stated on the Freshness page — that page controls over any marketing description.

Accounts and keys

You are responsible for activity under your account and keys. Keys are per-account, non-transferable, and stored by us as hashes; guard them as credentials. We may suspend keys for abuse, non-payment, or breach of the API Terms, with notice except where abuse is ongoing.

Prices, billing, cancellation

Prices are those published on the pricing page. Subscriptions are billed by Stripe in advance for the billing period chosen. You may cancel at any time; cancellation takes effect at the end of the current paid period, and access continues until then. Refunds are governed by the Refund Policy. Price changes are published on the pricing page first and apply to existing subscribers only from their next renewal after notice.

Acceptable use

You may not use the Services to: build profiles of private individuals (including wealth or vulnerability screening); make FCRA-regulated eligibility decisions (credit, employment, housing, insurance); re-identify individuals from aggregate data; resell or re-serve the data except as your tier's license allows (see Licensing); or interfere with the Services' operation. Public-record data about individuals acting in public or official capacities may be used as licensed.

Intellectual property

Public-record data belongs to its issuing agencies. ATCSTW claims rights in its resolution, connections, compilations, and presentation. The ATCSTW and Lux names and marks are trademarks of ATCSTW (™). Content you create in the Suite (lists, campaigns, reports) is yours; you grant us the license needed to operate the tool on it.

Disclaimers and liability

Except as an Enterprise agreement expressly provides, the Services are provided as-is, without warranty of accuracy, completeness, or fitness for a particular purpose — public records contain errors, and our Methodology and Corrections log describe how we handle them. To the maximum extent permitted by law, ATCSTW's aggregate liability arising from the Services is limited to the amounts you paid in the 12 months before the claim.

Changes and governing terms

Changes are published here with a date; material changes are announced to account emails before taking effect. Where these Terms conflict with a signed Enterprise agreement, the agreement controls.
